Abstract:The present Patents Act of Malawi is based on the legislation of the Patents Act, 1957, of the former Federation of Rhodesia and Nyasaland. It has received no major changes since independence. The main provisions of the Act are outlined and discussed under the following headings: administration of patent registration, facilities for international applications, procedure for application for patents, grant of the patent, compulsory licenses, disputes between employer and employee, actions for infringement, assignments and corrections, patent agents, appeals and the Patents Tribunal, miscellaneous matters. Given the fact that there has been no reported case involving the interpretation of the Patents Act of Malawi, it appears that there are few, if any, problems raised in the implementation and interpretation of this legislation by the Registrar.
