Abstract: | The South African Law Commission produced a working paper that recommends the protection of human rights and the recognition of group values, not on the basis of race. Since the Law Commission is an organ of Government, one can wonder whether the system of apartheid has finally been condemned by the Government itself. To examine this, the paper describes the nature of the working paper, its background, contents and implications. It argues that it is essential that a Bill of Rights as recommended by the Commission becomes part and parcel of the negotiations concerning a new constitution. |
