Abstract: | The Convention on the Liability of Terminal Operators is not very helpful to landlocked countries such as Lesotho, Malawi, Zambia, and Zimbabwe, because it tries to solve problems of countries which have a coastline. For countries which are landlocked, it is important that they accede to the United Nations Convention on International Multimodal Transport of Goods. The author outlines the provisions and scope of application of this Convention and notes that under the terms of this Convention, the operator remains liable throughout the various modes of transport until delivery of the goods has taken place. In addition, this Convention strikes the balance regarding all the legal regimes and therefore easily fosters regional integration. In this regard, the author urges the PTA States, as well as the SADCC countries, to consider its adoption. To date, only Malawi has done so. |
