Abstract: | In 1987 the Malawi parliament passed the new Trade Descriptions Act, repealing the Merchandise Marks Act, 1958. The principal object of the 1987 Act is to increase the legal protection of consumers of goods in Malawi by preventing traders from misdescribing their goods. In doing so and by imposing penalties on those who contravene the prohibition, the new Act gives the consumer more protection than the 1958 Act. Discussing its different sections, the author examines the main offences created by the Act. He draws considerably on case law which has grown over the years under the English Trade Descriptions Act, 1968, which is similar to the 1987 Act of Malawi. Notes, ref.. |
