Abstract:In 1988 the old Town and Country Planning Act of Malawi which was enacted in 1948 was replaced with the Town and Country Planning Act 1988. This paper highlights the new provisions made to cater for the major changes introduced or to be introduced into the planning practice of the country. It focuses on planning authorities, plans and plan making (the National Physical Development Plan, District Physical Development Plans, Local Physical Development Plans), development control and enforcement, special areas (the Land Development Control Area Order, the Improvement Area Order, the Vacant Land Development Order, the Building Preservation Order, the Accelerated Development Area Order, Subdivision Control Area Orders), development by government departments, and acquisition of land and compensation. By introducing three tiers of physical planning, the Act has made the planning process more comprehensive. At the same time, the orders empower the Minister responsible for planning to control and promote development in nonstatutory planning areas through declaration of the relevant orders. Bibliogr.
