Abstract: | This article deals with the dissemination of family law reforms to rural communities in Botswana. The first section describes the pluralist legal setting within which the dissemination of these reforms took place. Using the laws of marriage, divorce, inheritance and maintenance as illustrations, the author shows the options available in the dual regimes of customary law and the received Dutch-Roman law, as well as the statutory reforms introduced in these laws. The second section turns to the ways in which the reforms have been disseminated, and evaluates their effectiveness and limitations. Special attention is paid to the 'women-oriented' approach which was adopted in 1981 after the establishment of a Women's Affairs Unit in the Ministry of Home Affairs and the Women's Development Planning and Advisory Committee. The concluding section suggests ways in which the situation may be improved. Bibliogr., notes, ref. |
