Abstract: | This paper examines the export of toxic (nuclear and industrial) waste from developed countries to Africa in the light of the African Charter on Human and Peoples' Rights, which came into force in 1986. It first sketches the evolution of the right to a clean environment, the African Charter on Human and Peoples' Rights and the environment, and the recent development of export of toxic waste to Africa. Then it surveys toxic waste agreements between foreign firms and five African States (Guinea Bissau, Benin, Equatorial Guinea, Congo, and the Central African Republic), between foreign firms and private individuals in Africa, notably Nigeria and Guinea, and pending toxic waste transactions in Angola and Namibia. Finally, it discusses the effects of toxic waste dumping and efforts within the OAU, the EC, and the OECD to deal with the problem of toxic waste export. Notes, ref. |
