Abstract:This paper deals with the economic status of women in Kenya, particularly with respect to property rights, and the legal provisions, both customary and statutory, which concern women and ownership in the country. It discusses the position of unmarried, married and divorced or widowed women in the four systems of law which are applied in the country: statutory law, Islamic law, Hindu law, and African (traditional) law. Four cases are described which illustrate the conflicts between these laws in the area of women's property rights. The cases concern the division of matrimonial property at divorce, the (lack of a) proprietary regime governing cohabitation, inheritance, and burial.
