| Abstract: | This article analyses the Malawi Republic Constitution of 1966 in order to identify those provisions that entrench and legitimize undemocratic notions and practice. The author first outlines the circumstances in which the Constitution came into being, notably the transition of Malawi to a one-party State. Then he discusses a number of constitutional provisions, arguing that a thorough revision of the Constitution is needed in light of the foreseeable democratization process and the transition to a multiparty system.
