Abstract: | Although Roman-Dutch law did not discriminate on the basis of race or colour, race has undoubtedly had an impact on the administration of justice as it has developed in South Africa. Unlike in other countries, the influence of race on access to justice and the administration of justice has not sufficiently enjoyed the scrutiny of academic lawyers in South Africa. This article explores whether race in South Africa does affect a person's access to justice and whether race influences the administration of justice. An evaluation of unconscious racial prejudice demonstrates that racism is deep-rooted and pervasive in South African society. Various steps that can be taken to minimize or eliminate the influence of race on the adminstration of justice are suggested. Notes, ref. |
