Abstract:Ghana's Land Title Registration Law 1986 has introduced changes that will affect land transactions and conveyancing. These include the new uniform terminology adopted and, most importantly, the introduction of 'a system of compulsory land title registration throughout Ghana (which, according to the Memorandum), will be implemented in stages beginning with the Greater Accra Region and in designated agricultural areas'. The author examines these changes and considers whether the provisions of the law are adequate for ensuring its successful implementation and operation. Several sections of the Land Title Registration Law, in particular the provisions relating to maps and surveys, the provisions on adjudication, and those on group ownership, come in for criticism. The author also foresees potential social problems arising from the Law's favouring of individual over communal ownership of land. But the real obstacles are likely to come from the fact that for the system to work well as contemplated, the government must be prepared to commit large sums of money to it. Notes, ref.
