Abstract: | Although the Union between Tanganyika and Zanzibar was established in 1964, its structure and nature continue to present considerable problems. Neither in the Articles of Union nor in the constitutions of the United Republic of Tanzania and the Zanzibar Revolutionary Government is the nature of the union expressly mentioned or defined. Nowhere is it clearly stated whether the union is of a unitary or a federal nature. Recently, complaints of unequal treatment of Zanzibar within the union have again been seriously raised. This study first examines the interplay between the social, economic and political factors which gave rise to the agreement of the union, and then analyses the Articles of Union in order to establish whether they envisaged a federal, unitary or 'sui generis' constitution of the State. It also pays attention to the Fifth Constitutional Amendment Act 1984 and the 1984 Constitution of Zanzibar, arguing that they have not changed or resolved the problems facing the union. The case of Haji v. Nungu and Another (1987) is discussed as an illustration of these problems. Notes, ref. |
