Abstract:The African Charter on Human and Peoples' Rights, 1981, has made a genuine effort to base the human rights it provides for on both formal equality and relative equality so as to make the enjoyment of these rights meaningful. However, it limits the provision of relative equality through special measures of protection to only women, children, the aged and the disabled (article 18). The author argues that this is too restrictive. The political, economic and social relations existing between societal groups in many African countries make it imperative that the right to special measures of protection be extended to other groups.
