Abstract: | The African Charter on Human and Peoples' Rights has now been operational for six years, having come into force in October 1986. After summarizing the normative prescriptions and institutional arrangements of the African Charter, the author assesses the operational effectiveness, efficiency and coherence of the African regime with special reference to interstate communications, special cases, emergency cases, individual communications and the general field of promotional activities. The overall picture which emerges is that of an extremely weak regime which has been of little use in the promotion and protection of human rights. Moreover, the available evidence on the contents and operational experience of the African regime confirms that it is a model of 'lex imperfecta' and 'lex simulata'. Ref. |
