Title:The legal position of widows in Tanzania

Abstract:Although widows represent quite a large section of the population of Tanzania, their legal interests have been rather neglected by the Tanzanian legislator. This becomes particularly apparent if one compares the property and residential rights of a widow under customary law with those of a deserted or divorced woman under the 1971 Law of Marriage Act. While a comprehensive reform and integration of the existing laws of marriage and divorce was achieved in 1971, this spirit could apparently not last long enough to achieve a similar reform of succession law. However, a new impetus might now arise, drawing on the constitutional Bill of Rights, which became effective in 1988, and which includes, amongst others, the principle of equality. The courts now have to adapt existing laws - including customary laws - to bring them into conformity with the Tanzania Bill of Rights. Bibliogr., notes, ref.
