Abstract: | This article identifies some of the problems which HIV/AIDS poses for an employment relationship and how law continues to deal with them. Four countries are considered: Botswana, South Africa, the UK and the USA. After a short description of some medical facts about HIV/AIDS, the article discusses the limited direct contact between HIV/AIDS and statutory law. Then it considers the general principles of law bearing on HIV/AIDS and the discrimination suffered by individuals with HIV/AIDS. Finally, the article considers the relevance of HIV/AIDS in the context of labour law. The discussion follows the chronological sequence in the employment relationship, namely, recruitment, conditions of employment and dismissal. Notes, ref. |
