Abstract: | Once the United Nations begins to use force, as in the case of its recent operations in Somalia, there arises not only the problem of its 'neutrality', but also and especially that of its international responsibility in the case of violations of the UN Charter. After looking at the hidden background of the UN 'peacekeeping' operation in Somalia, the author examines the question of the international responsibility of the United Nations for fault and for risk and its consequences. He wonders whether the United Nations, as defender of human rights, does not have an obligation to repair the damages caused in Somalia. There is clearly an urgent need to regild the image of the UN. Ideally, the UN should develop an overall programme of action on human rights, including recommendations aimed at the prevention of human rights violations within the framework of 'peacekeeping' operations, the compensation of victims of human rights violations perpetrated within the framework of such operations, and the respect of international humanitarian law by 'peacekeeping' forces.
