Abstract: | Zambia's quest for a land policy in rural areas which will preserve the rights of the peasants under customary law for posterity on the one hand, but will also draw the peasantry into commercial agriculture on the other hand, is of long duration. This paper discusses the land policy adopted by the new Movement for Multi-Party Democracy (MMD) government which came to power in 1992. It reviews the Lands Bill (No. 43 of 1994) in so far as it is related to rural land. The paper first deals with the problems of land holding under customary law. It shows that the absence of title deeds and the insecurity of tenure under customary law are obstacles to agricultural development, and it proposes procedures for the acquisition of title deeds. Next, the paper pays attention to noncustomary interests in rural areas, looking at the question of whether the freehold system abolished by the Land (Conversion of Titles) Act 1975 should be reintroduced or whether the leasehold system should continue. The National Union of Farmers, representing commercial farmers, is in favour of the reintroduction of the freehold system, but the government prefers to retain the leasehold system. The conclusion is that the new Bill is a good step forward in so far as it is related to land under customary law. Notes, ref. |
