Abstract:In the ordinary course of divorce proceedings, custody disputes and the law, the trend appears to be that a mother will be awarded custody of her minor children unless specific evidence is adduced to prove that she is unfit to be the custodian of her children's welfare. This article illustrates the persistent discrimination encountered by lesbians in Family and Divorce courts, focusing on the South African law before the Constitution of the Republic of South Africa Act 200 of 1993, comparative law, and the impact of Act 200 of 1993. Several cases from South Africa and elsewhere serve as an illustration. Ref.
