Abstract: | Although the Republic of South Africa Constitution Act 1993 contains provisions that go a considerable way towards regulating the position of international agreements, these provisions are not entirely satisfactory. They are not entirely clear, and they are not comprehensive in that they simply do not address certain problems. This article highlights the defects in the provisions in the hope that they will receive appropriate treatment when the definitive constitution is being drafted. It considers the following topics: the continuation of treaties, the signature of treaties, authorization of ratification of treaties, ratification of treaties, incorporation or translation of treaties into municipal law, and the constitutionality of treaties.
