Abstract:South Africa's Prevention of Family Violence Act, which became operational on 1 December 1993, provides for the conviction of a husband for the rape of his wife; the granting of interdicts with regard to family violence; and the imposition of a duty on certain persons to report cases of ill-treatment of children. Despite being perceived as a breakthrough for women, the Act has many limitations: limited relief and lack of definition, procedural problems, problems connected with jurisdiction, the lack of a provision for appeal or review, enforcement problems, and the issue of costs. The Act urgently requires amendment and support services to render it more effective. Notes, ref.
