Abstract:This paper critically examines the investigatory powers of the Public Cornplaints Commissioner as contained in the Public Cornplaints Commission Decree 1975 (Decree No. 31 of 1975). After an introductory section follow the sections: II - examination of those provisions of the Decree setting out the investigatory functions of the Commissioner; III - examination of the limitations to the exercise of such functions as contained in the Decree; IV - the tools placed at the Commissioner's disposal by the Decree for effectively carrying out those functions, with examination whether those tools are adequate or not; V - the prevailing attitude of the Commissioners in the light of their outcry against the unco-operative attitude of officials and whether such is the correct approach; VI - some suggestions as to the possible improvements that could be made to the Decree and also in relation to the Commissioners, attitude in exercising their investigatory powers.
