Abstract: | In March 1995, eleven months after the genocide, the author visited Rwanda in order to explore possibilities for reconciliation, reconstruction, and development. In this paper he addresses the plight of the vanquished Hutu refugees who have returned to Rwanda under a cloud of suspicion or outright condemnation. He outlines several legal steps in the process of reconciliation and rebuilding confidence and the reinstitutionalization of the rule of law: 1) to prepare a list of people suspected of genocide; 2) to create a 'Commission de Triage' to select the leaders of the genocide; and 3) to elaborate criteria to determine the level of participation of those who served in various roles during the genocide. The commission should be given the mandate to start procedures for plea bargaining which could lead to a speedy trial of people selected in different groups, a reduction of the number of people incarcerated, and the introduction of 'work camps'. Through the mechanism of plea bargaining and a collective form of retribution for the guilty, it will be possible to build a decent society in Rwanda and give ethnicity a place.
