Abstract:The Working Party on African Land Tenure, 1957-58, in Chapter IX of its report recommended a system which was designed to achieve the aims of land policy in Kenya whilst at the same time being acceptable to the peoples themselves. The most important of these aims are mentioned in this article, which also deals with the procedure for registering a transmission (Section 79 of the Land Registration - Special Areas - Ordinance, 1959) as it works in practice. This system failed for several reasons. Accordingly, in September 1961 a new system was brought into operation, which instructs Chiefs and headmen to report the death of all registered landowners to the assistent registrar. It is too early to say whether the new system will succeed. The Working Party on African Land Tenure (paragraph 76 of its Report) urged the speedy enactment of legislation of the testmentary capicity of Africans. In December 1961 the temporary African Wills Ordinance was enacted. So far as is known, only one African, a woman, has made use of the new powers. References; appendix.
