Abstract: | The Sharia governs the personal and family law of Sudanese Muslims and constitutes a separate legal system from the Civil law of the Sudan. This paper deals with one topic in the Sharia and is part of a more general study of Islamic law which was conducted in the three towns known as Khartoum during 1979-80. Hadana, the care and custody of children, is a matter which is subject to variation in practice depending on which school of Islamic jurisprudence is applied in a given country. The Sudan provides an example of the application of the Hanafi code as modified by Maliki principles, developed through the issuance of Judicial Circulars by the Sudanese Grand Qadi. Before proceeding to the particulars and cases in the Sudan exemple, a brief review of the general features of the law regarding hadana is given. Bibliogr., notes, tab. |
