Abstract:With the passing of the Matrimonial Act of 1971, English statute and case law cease to govern matrimonial causes in Ghana. Previously, English laws were automatically applicable by virtue of section 17 of the Courts Ordinance which stated that the jurisdiction of the High Court in Probate, Divorce and Matrimonial Causes and proceedings shall be exercised in conformity with the law and practice for the time being in force of England. By the new law divorce has been made easier. Couples will no longer need to advance fictious grounds for divorce. As far as the ground for divorce is concerned the new Act has brought the statutory law in conformity with traditional law. Notes.
