Abstract:The first part deals with the juridical aspects of section 318(2) of the Criminal Code, 1960 (Act 29), which came into force on February 1st, 1961. This section repeals the Criminal Code (Cap. 9 of the Laws of the Gold Coast - Ghana, 1951 Edition) but re-enacts sections 448 and 449 thereof in a slightly modified form. Section 265 of the Criminal Code, 1960 contains the re-enacted provisions. In the second part, the question of the effect on the solidity of the second or subsequent marriage of the first or former marriage is examined by discussion of several sections of the Marriage Ordinance. The Postscript is concerned with the proposals of the White Paper on Marriage (published 13th May, 1961) relating to marriage.
