Abstract:Three forms of marriage are possible under Nigerian law: Customary, Moslem and 'Ordinance' marriages. The paper does not deal with the law governing intestate succession when the marriage is either a Customary Marriage or a Moslem Marriage. The Marriage Act applies throughout the Federation of Nigeria because marriage is a matter within the exclusive legislative of the Federal Parliament. Succession is a Regional matter. The article discusses the diverse forms of intestate succession. According to the author the present state of the law on intestate succession is unsatisfatory if only because of the many cases not covered by the existing law.
