Abstract: | The use of cheques for the payment of salaries and other dues is a growing trend in Lesotho. The operation of cheques is regulated by the Lesotho Bills of Exchange Proclamation 13 of 1912, the common law, as well as banking trade usage. Although cheques are perceived as a safe mode of payment, they are open to abuse and misuse. This article examines the risks associated with the use of cheques from the standpoint of a drawer, a bank, and the payee/holder through an analysis of the different methods of drawing cheques, with specific reference to Lesotho legislation.
