Abstract: | In Botswana there have been repeated calls to amend certain laws relating to maintenance of children born out of wedlock on the basis that those laws did not adequately address the needs of such children. Application for maintenance for children born out of wedlock is governed by the Affiliation Proceedings Act. The present article examines the provisions of the Act relating to both paternity and maintenance claims, and analyses the recent amendment (1999) of the Affiliation Proceedings Act to determine whether it adequately addresses the interests of the children concerned.
