Abstract: | On 6 April 2000 the National Assembly of Botswana passed the Copyright and Neighbouring Rights Act. This law repealed the Copyright Act of 1965, which covered largely traditional written works and was not up to date with current technological developments. The author presents an overview of the new Copyright Act, which legislates over areas not previously covered, namely expressions of folklore, computer programmes and databases. The new law strengthens the economic and moral rights of copyright owners, and affords protection to performers. It also introduces further stringent sanctions for the infringement of copyright and neighbouring rights. These provisions ensure Botswana's compliance with the GATT/WTO Agreement on Trade Related Aspects of Intellectual Property (TRIPS). Notes, ref. |
