Abstract: | Before the Koko incident in 1988, when an Italian company tried to dump toxic waste at Koko in the former Bendel State, legislation relating to the environment in Nigeria was almost exclusively restricted to petroleum activities. Following the Koko incident, various pieces of legislation aimed at protecting the environment were enacted. These include the Federal Environmental Protection Agency Act, the Harmful Waste (Special Criminal Provision) Act, and the Impact Assessment Decree. This article critically examines the provisions of Nigerian legislation on environmental protection and the guidelines on environmental impact assessment in order to ascertain the legal requirements for both foreign and local investors in respect of environmental impact assessment.
