Abstract: | This article considers the position of children in South Africa under the new constitutional dispensation, as seen in comparative perspective and in the light of present and proposed legislation and of indigenous law. This is done with a view to possible legal reform in the private and public domain. The article discusses relevant case law and suggests that the development of indigenous law might be effected in accordance with the concept of 'ubuntu' and the values entrenched in the Republic of South Africa Constitution Act 108 of 1996. 'Ubuntu' is seen as including, amongst others, the idea of group solidarity and the interdependence of members within the group. Bibliogr., notes, ref., sum. [Journal abstract] |
