Abstract: | Notwithstanding the potential for e-commerce growth in the UEMOA and ECOWAS regions, the volume of electronic transactions is currently low. Identified obstacles to electronic commerce development in the West African region include the inadequacy of regulations relating to legal recognition of data messages and recognition of electronic signatures and the absence of specific legal rules protecting online consumers and data. To overcome these obstacles and create an enabling legal environment to facilitate intra-regional commercial activities and attract foreign investments into the region, the ECOWAS and some of its member nations including Nigeria and Ghana have created their own version of a legal framework for e-commerce. This article reviews the ECOWAS e-commerce guidelines and assesses its adequacy in overcoming the legal challenges to e-commerce development in the region. Notes, ref. [ASC Leiden abstract] |
