Abstract: | Lesbian, gay, bisexual, and transgender persons in Nigeria face legal and social challenges not experienced by those not in that category. There is no well articulated legal protection against same sex marriage discrimination in Nigeria. Most Nigerians believe that homosexuality is a way of life that society should not accept, a position that has been widely criticized by human and civil rights organizations as well as the United Nations. This article examines same sex marriage in the Nigerian context from a human rights point of view. The article sets apart arguments for the recognition of same-sex relationships in Nigeria, then looks at anti-discriminatory protection in the country, and finally considers Nigeria's obligations under international law and human rights treaties, to which Nigeria is a signatory.
