Abstract:This study concerns the alarming situation in the mining sector in the democratic republic of congo (drc). it concerns the control of the activities of foreign multinational mining companies operating in the national territory. with the liberalization of the mining sector in the drc, the influx of foreign companies into this sector has become difficult to control by a state that is struggling to function. foreign multinational mining companies use or abuse their financial resources to profit from the minerals of the drc in the detriment of the state and the local communities. argor-heraeus affairs and the chinese company kun hou mining highlight the cyclical difficulties and passivity of the congolese state in controlling the activities of multinational mining companies operating in the country illegally, in defiance of laws and good practices in this area. hence the need for a regal power capable of defending and protecting the sovereignty of the drc over its natural resources.
