Abstract:The present article sets out the contentious electoral procedure before the constitutional court, with particular reference to the presidential election, distinguishing between ordinary procedural matters relating to any dispute: the status of the applicant, the subject-matter of the action, the composition of the court, the examination of the appeal, the time-limit for investigation, the decision of the court and possible appeals... and on the other the enigmatic procedural issues specific to [congolese] electoral disputes, the inquisitorial nature of which requires the electoral judge to proceed ex officio and the principle of decisive influence that allows the judge to be a judge of the sincerity of the elections and not judge of the legality. these questions call for a strong positioning on the part of the supreme electoral judge for the emergence of an electoral justice that inspires confidence in the actors.
