Abstract: | The illegal exploitation of congolese minerals has been the cause of massive human rights violations, but also the destruction of the congolese economy by the loss of real funding to enable it to reduce the poverty of the congolese population . which is an infringement of the sovereign right over natural resources. it is in an attempt to put an end to this that legal mechanisms have been put in place at the international, subregional and even national levels. their theoretical efficiency is severely tested in the face of the divergent interests of the actors involved and by the weakness of the congolese state, a weakness demonstrated by the lack of jurisprudence on the subject that would have a pedagogical role of dissuasion to play with all. those who ventured there again. |
