Abstract: | The duty to safeguard jobs led the government to take certain measures, including prohibiting mass layoffs during the period of the state of emergency proclaimed following the covid-19 in the drc. on the other hand, it is the right of companies facing economic difficulties to reorganize, in particular by reducing the number of their workers. this article examines the applicability of this prohibition in the light of the catastrophic situation of employers, by specifying both the legal nature of covid-19 in labour law and its effects in industrial relations between worker and employer. finally, what are the prospects for the state in the face of a phenomenon of the nature of covid-19, with a view to its effectiveness in protecting jobs and the contagion of its effects? |
