Abstract:La course au 'développement économique utilisé comme un des critères de l'investissement et le développement durable visant à intégrer les préoccupations environnementales dans le droit international de l'investissement', ne laisse aucun état indifférent aujourd'hui. assurément pour l'état congolais, le développement s'inscrit comme un objectif à atteindre mais aussi comme un moyen lui permettant d'amplifier sa croissance économique par le biais d'investissements internationaux. it is in this context that the congolese government concluded on 17 september 2007 and 22 april 2008 respectively a memorandum of understanding and a collaboration agreement with a group of chinese companies with the aim of carrying out mining and infrastructure projects. to address the question of the developmental impact of chinese investments in the democratic republic of congo is to raise the issue of the meeting between foreign capital and the development of this state. the purpose of this article is to propose, after having proceeded to the analysis of these two legal acts, appropriate solutions in order to translate these contracts into a real instrument at the service of the economic development of the drc, while ensuring the chinese side a rational commercial gain.
